1. Acceptance of These Terms
These Terms of Service set out the agreement between you and BrooksCo LLC for the use of the website at brooksco.buzz and for any dock service you book with us. By browsing the site, sending a request through the contact page, calling the dock line or arriving at the yard, you accept these terms.
If you book on behalf of a group, you confirm that you are authorized to act for that group and that you will share these terms with the people who will be at the plank. A group leader is responsible for making sure that every participant understands the briefing and the rules described here.
If you do not accept these terms, please do not use the site or make a booking. You may still call the office to ask a general question, but a service cannot be provided without agreement to these terms.
2. Who We Are
BrooksCo LLC is a limited liability company with its dock yard and office at 1565 W 2950 S, Vernal - 84078-4681, United States (US). The business operates a green river dock and a small computer systems design practice. The website is maintained by the developer known as BrooksCo on behalf of the company.
The company may be reached by email at info@brooksco.buzz or by phone at +16817321334 during dock hours. Written notices should be sent to the postal address above. A notice sent to the developer name rather than the company name will be forwarded, but the company address is the reliable route for anything that must be recorded.
References to we, us and our in these terms mean BrooksCo LLC. References to you and your mean the person using the site or booking a service, and where relevant the group that person represents.
3. Dock Services We Provide
We provide six dock services, described in more detail on the services page. They are group river days, gear shed hire, shuttle run coordination, dockside storage lockers, season launch support and safety briefing sessions. Each service is delivered from the same dock yard and the same plank.
A service is provided for the date, time and scope written on the booking board. Anything not written on the board is not part of the service, even if it was discussed informally. If you need an addition, ask for it to be written on the board so that the right hand is assigned and the right gear is set aside.
We may decline a booking where the water, the weather, the condition of the dock or the makeup of the group makes the service unsafe or impractical. We may also decline a booking where a previous visit ended with unpaid charges or repeated disregard for the rules on the plank.
Our computer systems design work is governed by a separate written agreement with each client. These terms cover the website and the dock services, and they do not replace a design agreement.
4. Bookings and Confirmations
A request sent through the contact form or left on the dock line is a request, not a confirmed booking. A booking is confirmed only when the dock office tells you that a berth, a shed or a shuttle has been set on the board. Until that message arrives, the date remains open to other groups.
The booking will record the group name, the contact number, the date, the service, the approximate number of people and any specific need you have told us about. Please check the confirmation and tell us at once if something is wrong. A correction made early is easy to absorb, and a correction made on launch morning is not.
For a group river day, the group leader is expected to arrive at the meeting time with the full party. Late arrival may shorten the day or, where the shuttle cannot wait, may result in the booking being treated as a cancellation under the section below.
We recommend booking two to three weeks ahead in spring and four weeks ahead in summer. Holiday weekends fill first, and a shed or a locker may be held only for a limited time while a deposit is arranged.
5. Prices, Deposits and Payment
Prices are quoted at the time of booking and are based on the service, the size of the group and the length of the hire. A quote is valid for the period stated in the message, and after that period it may be revised to reflect a change in cost or availability.
Some services require a deposit to hold a date, particularly group river days and season shed hires. A deposit is applied to the final charge. The balance is due at the dock before the service begins, unless the office agrees to a different arrangement in writing.
We accept the payment methods listed on the confirmation message. A returned payment, a chargeback without an agreed reason or an unpaid balance may result in the booking being released and the deposit being applied to the cost already incurred, such as a shuttle that was already driven.
Prices may change for future bookings, and a change will not be applied retroactively to a booking that was already confirmed. Taxes and any lawful fees are added where they apply and are shown on the confirmation.
6. Cancellations and Rescheduling
You may cancel a booking by calling the dock line or writing to the office email. A cancellation is effective when the office acknowledges it, so please keep a record of the time you sent it. A message sent late at night is read when the office next opens.
A deposit is refunded in full where you cancel at least seven days before the booked date and where no specific cost has already been committed on your behalf. A cancellation inside seven days may retain a part of the deposit to cover a shuttle that was already scheduled or a shed that was withdrawn from the open list.
If we cancel a service because of unsafe water, dangerous weather or a failure on our part, you may choose a full refund of amounts paid or a rescheduled date at no additional cost. We will not keep a deposit for a day that we could not safely deliver.
A no show without notice is treated as a cancellation on the day, and any deposit is retained. If you are delayed, call the dock line as soon as you know. A short delay can often be absorbed, and a call is always better than silence.
7. Conduct on the Dock and on the Water
The plank is a working surface. Please walk, keep your hands free, and keep bags clear of the edge. Running, pushing or jumping between berths is not permitted, and the dock hand may ask a person to leave the plank if conduct puts others at risk.
Alcohol and any substance that impairs judgment are not permitted before or during a service. A person who appears impaired will not be allowed to board, and the group will be briefed on the options available. This rule applies to every participant, not only the person steering.
Please follow the directions of the dock hand and any instructions given in the briefing. A route may be changed at short notice, and a landing may be moved. Your booking covers a service delivered with reasonable care, not a specific line on a map.
Pets may be brought only where the office has agreed in advance and only if the pet is under control at all times. Loose animals are a hazard on a plank and are not permitted in a shed or a locker area.
We may end a service without refund where a person refuses to follow a safety instruction, damages dock property, harasses another person or interferes with the safe operation of a shuttle. In that case the group is responsible for the cost of returning to the takeout.
8. Safety Briefings and Personal Flotation
A safety briefing session is part of every group river day and may be booked on its own. The briefing covers the current of the day, the signals the group will use, bracing in a moving boat and the response when a hull turns. Attendance is required before boarding.
A personal flotation device must be worn, correctly fitted and fastened for the whole time a person is on the water. Carrying a device in a hand or leaving it in a boat does not satisfy this rule. A person who will not wear a device will not be allowed to launch.
The dock hand may adjust the plan, shorten a route, change a landing or stop a service where the river, the weather or the condition of the group makes the original plan unsafe. A decision made for safety is final for that day, and the refund options in the cancellation section apply where the service cannot be delivered.
A briefing is a practical session, not a certification. It does not qualify a person to lead a group independently, and it does not replace the judgment of the hand assigned to the day.
9. Gear Sheds and Stored Equipment
A gear shed is hired for the period written on the hire sheet. The key tag matches the shed and the berth number, and the key must be returned at the end of the hire. A key that is lost or not returned may attract a charge for a replacement lock and a new set of tags.
You are responsible for the equipment you store and for keeping the shed in reasonable order. Racks are rated for the loads described on the tag, and a hull must be placed on the rack in the way the office explains. Items that block the door or the ventilation are not permitted.
We keep the sheds dry and ventilated, but we cannot guarantee the condition of an item stored by a customer. Please do not store food, fuel, a battery that may leak or anything that could damage other equipment. We may remove and dispose of unsafe or perishable items after notice.
Property left in a shed after the hire ends is handled under the left items rule in the locker section. A shed is not a storage unit for an unlimited time, and a hire must be renewed before the end date if the shelf is to stay reserved.
10. Storage Lockers and Left Items
A dockside storage locker is hired for the period shown on the tag. The tag number is written on the gate log, and the tag must be kept safe during the visit. A lost tag can be traced to the log, but the lock may need to be opened by a hand with the office present.
Lockers are for small personal items such as keys, phones, medication, wallets and a folded layer. They are not intended for a large bag, a cooler, a fuel can or any item that could leak or smell. The office may refuse an item that does not fit the purpose of the locker.
A locker must be emptied before the end of the hire period. An item left behind is held in the office for a limited period, after which it may be disposed of or donated. Perishable items and items that pose a hazard may be removed sooner without notice.
We take reasonable care of a left item, but we are not an insurer. Please do not leave a valuable item in a locker for a period longer than your visit unless the office has agreed to a longer hire in writing.
11. Shuttle Runs and Vehicles
A shuttle run is coordinated to move people and gear between the launch and the takeout. The route, the pick-up window and the driver contact are written on the shuttle board and confirmed before the day. Please read the board before you leave the yard.
A vehicle left at a takeout is left at your own risk. Please remove valuables, lock the vehicle and leave it in the place the driver marks. We are not responsible for damage, theft or a parking violation at a public landing.
The driver may adjust a pick-up time where the water or the road changes. If a group is late to the takeout, the driver may need to serve another group and return later. A delay caused by a group that ignores the board may attract an additional charge for the extra drive.
Trailers are loaded with the gear that is not needed afloat. A person riding in a shuttle is expected to wear a seat belt and to follow the driver on loading. The shuttle is not a freight service for an item that the office has not agreed to carry.
12. Assumption of River Risk
Moving water carries inherent risk that cannot be removed by any briefing, any boat or any dock hand. A person may slip on a wet plank, be tipped from a boat, become cold, lose an item or be injured in a fall. By booking a service, you accept those ordinary river risks.
We reduce risk with briefings, fitted flotation, checked boats and a route read each morning. We do not claim to remove risk, and we do not promise a particular outcome. A safe day depends on the water, the weather and the conduct of the group as well as on our preparation.
You are responsible for disclosing a medical condition that may affect your safety on the water, such as a heart condition, a seizure disorder or a serious allergy. Please tell the dock office at booking so the briefing can be adjusted. A person who conceals a relevant condition does so at their own risk.
A parent or guardian is responsible for a young person in their care at every point of the visit, including the plank, the briefing and the shuttle.
13. Limitation of Liability
To the fullest extent permitted by law, BrooksCo LLC is not liable for indirect, incidental, special or consequential loss arising from a dock service or the use of this website. That includes lost profit, lost opportunity and the cost of substitute arrangements.
Where liability cannot be excluded, our total liability for a claim connected to a dock service is limited to the amount paid to us for that service. Where a claim concerns the website alone, our liability is limited to the direct cost of the affected use.
Nothing in these terms limits a liability that cannot be limited by law, including a liability for fraud or for a duty that a statute makes non excludable. If a clause is found unenforceable, the rest of these terms continue to apply.
We are not liable for loss caused by a third party, including a theft at a public landing, a road closure, a failure of a payment provider or an act of a person outside our control. We will still help you report the matter and, where we can, put it right.
14. Indemnity
You agree to indemnify BrooksCo LLC against a claim, loss or cost that arises from your breach of these terms, your misuse of the site or the conduct of a person in your group. This includes damage to dock property and a claim brought by a third party because of an act by someone in your party.
The indemnity does not apply where the claim is caused by our own negligence or by a failure on our part to deliver a service with reasonable care. It is intended to cover the consequences of conduct that these terms already prohibit.
We will tell you promptly if a claim covered by this section is made, and we will allow you a reasonable chance to respond. You are not required to admit fault to satisfy this section, and a settlement will not be agreed without your reasonable consent where the claim concerns your group.
15. Website Content and Intellectual Property
The text, layout, styles and images on this site belong to BrooksCo LLC or are used with permission. You may read the site, print a page for personal use and share a link. You may not copy a substantial part of the site for another business, republish the text as your own or use the design as a template.
The name BrooksCo LLC and the dock identity used on this site are the property of the company. A reference to the company in a review, a news story or a directory is welcome and does not require permission, provided it is accurate and does not suggest an endorsement that has not been given.
If you believe that a page on this site infringes a right you hold, send a written notice to info@brooksco.buzz with enough detail to locate the material and to explain your claim. We will review the notice and respond promptly.
A link from this site to another site does not transfer a right in that site, and a link from another site to ours does not give that site a licence to use our content.
16. Acceptable Use of the Website
You may use this site for lawful purposes connected with a dock service or a general inquiry. You may not attempt to break into the site, probe its security, overload it with automated requests or use the contact form to send spam, malware or unlawful content.
You may not copy the site with an automated tool for the purpose of building a competing page, and you may not remove a notice that identifies the owner of the content. A search engine that indexes the site in the ordinary way is not affected by this rule.
We may suspend access to the site, decline a message or report conduct to a service provider where these rules are broken. We prefer to resolve a problem directly, and a short message explaining the issue is often enough to restore access.
17. Third Party Links and Services
The site may include a link to a mapping service, a weather forecast, a payment page or another resource. Those services are operated by other organizations under their own terms and privacy policies. We do not control their content and are not responsible for their conduct.
Where a payment is made through a third party page, the payment is handled under that provider terms. A dispute about a payment should be raised with the provider as well as with us, so that both records can be reconciled.
Please check the address in your browser before you enter payment details. A message that asks you to pay through an unfamiliar page should be treated with suspicion, and the dock line can confirm the correct payment route.
18. Privacy
Our handling of personal information is described in the Privacy Policy, which forms part of these terms. The policy explains what we collect, why we collect it, how long we keep it and how you may make a request about your information.
In summary, we collect what is needed to answer a message, hold a booking and run the dock. We do not sell personal information and we do not run advertising networks on this site. A question about privacy may be sent to info@brooksco.buzz or asked by phone at +16817321334.
If there is a conflict between these terms and the Privacy Policy on a question of personal information, the Privacy Policy controls on that question.
19. Weather, Water and Events Beyond Control
The river is the central fact of this business, and it is outside anyone control. Flood flow, unseasonal cold, high wind, lightning, wildfire smoke, a road closure, a bridge repair or a public health order may make a booked service unsafe or impossible.
Where an event beyond our reasonable control prevents a service, we will contact the booking contact as soon as we can, offer a rescheduled date and apply the refund options in the cancellation section. We will not charge for a service we could not attempt.
A group that chooses to travel to the dock during a closure does so at its own risk. The office may close the gate where the yard itself is unsafe, and in that case a sign at the entrance will direct you to the phone line.
20. Governing Law and Disputes
These terms are governed by the laws of the State of Utah and by applicable federal law of the United States. A dispute will be handled first in a court of competent jurisdiction in Uintah County, Utah, unless a mandatory rule requires another forum.
Before filing a formal claim, please raise the matter with the dock office by email or phone. Most concerns about a booking, a locker or a shuttle can be resolved with a conversation and a correction on the board.
If a claim proceeds, the parties agree to keep the details confidential except where disclosure is required by law or is needed to enforce a judgment. Nothing in this section prevents a person from raising a matter with a consumer protection body.
21. Changes to These Terms
We may revise these terms when the service changes, when a legal requirement changes or when a wording needs to be clearer. The date at the top of the page shows when the current version took effect.
A booking is governed by the version of these terms in force on the date the booking was confirmed. A later revision will not be applied to that booking unless you agree to it in writing.
Please read the terms again before a new season. A short note on the desk on the services page will point out a material change, and the Privacy Policy will note a change in a corresponding place.
22. Contact Details
Questions about these terms may be sent to the dock office by email at info@brooksco.buzz or by phone at +16817321334 during dock hours. The postal address is BrooksCo LLC, 1565 W 2950 S, Vernal - 84078-4681, United States (US).
For a written notice, please use the postal address and include a clear description of the matter and a way to reply. For a booking change, the phone line is usually the fastest route because the paper board is updated in the office beside the oar rail.
These terms are published by BrooksCo LLC. The website was designed and is maintained by the developer BrooksCo.
Read the Privacy Policy alongside these terms. Both documents describe how the dock is run, and both apply to a booking made through the site.
